Mr. Penn has extensive experience and legal expertise in real estate and property law, including things title disputes, quiet title actions, lien priorities, mortgages, landlord tenant issues, and real estate sale transactions. Mr. Penn previously worked as an in-house attorney for Old Republic National Title Insurance Company, one of the largest real estate title insurers in the U.S. In that role, Mr. Penn handled title insurance claims and title litigation involving all types of real property issues and problems.
Mr. Penn has successfully resolved hundreds of real estate matters for clients over the years, including those that involved litigation. He has won success for mortgage company clients in lien priority litigation to establish the priority of their lien over that of competing mortgage holders. Mr. Penn has also defended mortgage company and title company clients in lawsuits involving allegations of consumer finance violations, wrongful foreclosure, and other issues.
Mr. Penn has had similar success representing individuals in real estate litigation. He has handled cases involving disputed ownership interests in property, real estate sale and purchase contracts, adverse possession, foreclosures, short sales, and many other issues. Mr. Penn also frequently represents landlords and property managers in disputes involving tenants and other issues related to rental properties.

Title Litigation
Mr. Penn often represents title insurance companies and their insureds in title curative litigation and lien priority matters. Most of this work involves representing mortgage holders under lender’s title insurance policies that insure that they have a valid, first-position secured lien on certain property. Mistakes and errors during the closing process can often result in problems with a mortgage lien that need to be cured in order for the lender to foreclose. As a former in-house counsel at Old Republic National Title Insurance Company, Mr. Penn has significant first-hand experience and expertise when it comes to handling these situations with and without litigation.

Mr. Penn has extensive experience and expertise in the field of lien priority disputes. He has represented mortgage lenders, loan servicers, and title insurance companies in a number of cases seeking to establish lien priorities.
Mechanic’s Liens
When a contractor does work or supplies materials on a project and the property owner fails to make payment, the contractor can get a mechanic’s lien on on the property to secure payment.
